Terms of Service

In short:own what you sell, don't redistribute what you buy, and keep transactions on-platform so escrow can protect you. Fees are 30% on products, 35% on servers and 30% on services. This summary is not a substitute for the full terms below.
1. Acceptance of Terms
By accessing or using ModForge ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. We may update these terms at any time; we will post the updated version here and continued use after changes constitutes acceptance.
2. What ModForge Is
ModForge is a marketplace with four parts: (a) digital products — Minecraft and Roblox plugins, scripts, models, maps, GUIs, configs and asset packs; (b) game servers — established FiveM and Minecraft communities sold with an ownership transfer; (c) services ("gigs") — fixed-price work offered by approved sellers; and (d) a jobs board where clients hire developers. ModForge is a venue that connects buyers and sellers and holds funds in escrow where stated. Except where we act as the payment and escrow provider, we are not a party to the underlying agreement between a buyer and a seller.
3. Account Registration
You must be at least 13 years old to create an account, and old enough to form a binding contract in your jurisdiction. You are responsible for the security of your credentials and for all activity under your account. You may not share accounts, impersonate others, or create accounts to evade a suspension. We may suspend or terminate accounts that violate these terms.
4. Seller & Developer Eligibility
Selling products, offering services, and applying for jobs all require an approved seller account. Approval is at our sole discretion and may be revoked. By listing anything, you confirm you own or are licensed to distribute it and that it infringes no third-party rights. You must not list: assets you do not own, leaked/stolen or repackaged work, malware or obfuscated malicious code, or anything unlawful.
5. Listing Review
Digital products, job posts and services are reviewed by our team before they appear publicly. We may approve, reject, change the visibility of, or remove any listing at our discretion, with or without notice. Review is a basic quality and policy check — it is not a warranty that a listing is safe, functional, lawful, or accurately described.
6. Platform Fees
ModForge deducts a platform fee from the sale price before payout: 30% on digital products (sellers receive 70%); 35% on game server sales (sellers receive 65%); and 30% on services and dev-for-hire contracts (developers receive 70%). There are no listing fees or monthly charges — you only pay when you earn. Payment processor fees may also apply. We may change fees with 30 days' notice; the rate shown at the time of a sale is the rate applied to that sale.
7. Payments & Payouts
Payments are processed by Stripe and PayPal. ModForge does not store card details. Payouts are requested from your dashboard, subject to a minimum balance, and are sent to the payout method you provide — you are responsible for its accuracy. Proceeds from game server sales are held for 15 days after the sale while the ownership transfer completes. All amounts are in USD unless stated otherwise. You are solely responsible for your own taxes.
8. Escrow for Services & Dev-for-Hire
For gigs and job contracts, the client funds a milestone and ModForge holds those funds. The developer delivers, the client approves, and the funds (less the platform fee) are credited to the developer's payout balance. If the client does not respond within the auto-release window shown on the contract, the milestone releases automatically. Either party may raise a dispute while funds are held; ModForge will review and may release to the developer or refund the client. Contract chat opens only after a milestone is funded. You must not move a transaction off-platform to avoid fees or escrow — doing so voids all buyer and seller protection and may result in termination.
9. Licences & Protected Products
Unless a listing states otherwise, buying a digital product grants you a non-exclusive, non-transferable licence to use it on your own server or project. You may not resell, redistribute, sublicense or publish the files, or share them outside your organisation. Some products are protected: Minecraft plugins may ship encrypted with a licence key that binds permanently to the first server that activates it, and Roblox systems may validate against a Place/Universe ID. These keys are single-use and cannot be moved or reset — running the product on a different server requires a new purchase. We may revoke a licence key for a refunded, charged-back or abusive purchase, which disables the product.
10. Downloads & Anti-Piracy
Paid files are served through short-lived, purchase-gated links, and downloads are logged (including IP address and browser) to detect sharing. Distributing purchased files, sharing accounts or licence keys, or circumventing protection may result in licence revocation, account termination and forfeiture of any balance, without refund.
11. Refunds & Buyer Protection
Digital products are non-refundable by default because delivery is immediate and permanent. If a product is materially broken or significantly not as described, contact the seller first, then open a dispute within 7 days of purchase and we will investigate. We may issue a refund at our discretion. For escrow contracts, refunds are handled through the dispute process in section 8. Buyer's remorse, incompatibility you could have checked before buying, and finding it cheaper elsewhere are not grounds for a refund.
12. Reviews & Ratings
Reviews may only be left after a completed, paid transaction. You may not buy, sell, trade or incentivise reviews, review your own listings through another account, or use reviews to threaten or extort another user. We may remove reviews that break these rules.
13. Prohibited Content & Conduct
You may not list, sell or distribute: cheats, exploits or tools designed to harm other players' experiences; content enabling fraud, harassment or illegal activity; cracked or pirated software; content that violates the terms of the game it targets; or anything we deem harmful. You also may not scrape the Platform, interfere with its operation, attempt to bypass access controls, or use it to launder money.
14. Intellectual Property
Sellers retain ownership of what they list and grant ModForge a non-exclusive licence to host, display and market it while it is listed. The ModForge name, branding and site content are ours. If you believe your rights are infringed, send a takedown notice to support@modforge.xyz with proof of ownership and the listing URL; we will investigate, may remove the listing, and will terminate repeat infringers.
15. Suspension & Termination
We may suspend or terminate an account for any breach of these terms, fraud or chargeback abuse, repeated disputes, or where required by law. You may close your account at any time. On termination, live listings are removed; funds legitimately earned and not subject to a dispute remain payable, and funds tied to fraud may be withheld.
16. Disclaimers
The Platform is provided "as is" and "as available", without warranties of any kind. We do not warrant that listings are accurate, functional, secure or fit for purpose, that protection systems cannot be circumvented, or that the Platform will be uninterrupted or error-free. You use third-party content at your own risk.
17. Limitation of Liability
To the maximum extent permitted by law, ModForge is not liable for indirect, incidental, special or consequential damages, lost profits, lost data, or damage to your server or community. Our total liability for any claim shall not exceed the fees you paid to ModForge in the 90 days before the claim arose. Nothing here limits liability that cannot be limited by law.
18. Governing Law & Disputes
These terms are governed by applicable law. Disputes shall be resolved through binding arbitration on an individual basis, except where prohibited by law, and you waive participation in class actions. This does not affect mandatory consumer rights you have in your country of residence.
